Dear Members and Friends of SwissCham,

In commercial practice, dispute resolution clauses are often relegated to the end of contractual negotiations, or dismissed as standard formulation without further thoughts as to the context. But these clauses can have profound implications for how / when / where / at which cost the dispute is resolved.

This presentation will, with plenty of case studies from the practice, focus on how to agree on an efficient dispute settlement clause in the contract to avoid risks in practice, including the importance of the dispute settlement clauses, choice of forum between litigation and arbitration and the intersection between the two.

The presentation will be followed by a panel discussion and a Q&A session.

The event is organized under the legal committee of SwissCham Shanghai.

Zhang Zheng – Luther Law Offices
Project leader for an environmental and legal due diligenceinvestigation for a well-known German chemical logistics provider in relation to buying out the local joint venture partner.
Project leader for the Chinese part in negotiating and completing a divestment and restructuring by an European leading provider of technical services of a certain parts of Chinese testing and certification business.
Dispute concerning the termination of a joint venture between a global tier 1 automotive supplier and a local partner. Participated in arbitration proceedings in Vienna and obtained a favor-able ruling from the Chinese Supreme People’s Court.
Dispute on copy right of art works, representing globally active cultural institute in the court proceedings including hearing at the Chinese Supreme People’s Court, successfully rejecting all claims of the plaintiff.
Dispute on product liabilities against world’s leading nutrition products manufacturer, advising and representing the client in series of lawsuits and governmental investigations.

Besides her work on all aspects of commercial and corporate law, Mrs. ZHANG has sizable experiences with joint venture disputes and a steadily growing list of domestic litigation and international arbitration cases.
