China’s New Cybersecurity Law: Managing Risks and Legal Issues

The Legal Committee of SwissCham Shanghai is delighted to invite you to our upcoming event about China’s new cybersecurity law. We have invited speakers and panelists from Control Risks and Taylor Wessing to provide you an overview of what this new law means for you and your company.

Presentation by Control Risks:
The new cybersecurity law comes into force on June 1, 2017, which will concern a wide range of industries and leave many companies unsure about how the law will affect their business.

The new law mandates cybersecurity obligations and duties for network operators. Core provisions include defining critical information infrastructure (CII), mandating a national security review of CII cybersecurity systems and technology, and making rules to protect and localise personal and important data.

Carly Ramsey will brief on the operational implications of the new cybersecurity law and provide guidance on determining who/what is CII, which data needs to be localised and what steps you can take now to start mitigating these risks.

Presentation by Taylor Wessing:

The new PRC Cybersecurity Law will take its effect soon. Enactment of this law was already a controversial process which took a long time after 3 rounds of legislative review. This law reflects China’s increase concern over national security, which no question has a big impact on foreign companies’ operation in China. A widely discussed issue connected with this law is data local storage requirement.

Another issue of concern is the obligation of companies to cooperate with governmental agencies to facilitate invasive audit or investigation during law enforcement. Besides this law, there are more follow-up moves e.g. by the Ministry of Industry and Information Technology (MIIT) and the Cyberspace Administration of China (CAC) to be watched upon.

In this seminar, Michael Tan will discuss 1) a quick overview of the legislative picture including this new law and related ministerial moves; 2) practical issues and implications which concerns your operation in China; 3) best industrial practice and recommendations.

About the Speakers

Ms. Carly Ramsey Associate Director, Control Risks

Carly Ramsey is an associate director in Control Risks, a global risk consultancy specializing in political, integrity and security risk. Based in Shanghai, Carly advises companies operating in China how to successfully manage the commercial and operational challenges brought on by political and regulatory risk. Prior to joining Control Risks, Carly was with APCO Worldwide, where she provided corporate advisory, government relations, and corporate communications strategy to multinationals, trade associations, and governments.
She has a master’s degree in foreign policy and international security from Georgetown University and a bachelor’s degree in political science from the University of Western Ontario.

Dr. Michael Tan Partner, Shanghai Arbitratior of SHIAC

Michael has more than 10 years of experience advising multinational companies in their investments and operations in China. His experience includes advising on the establishment of foreign investment enterprises in various industries, M&A, restructuring and liquidation of foreign investment enterprises. He advises international clients in various industries including automotive, aerospace, general machinery, new energy, infrastructure and logistics. At the same time, Michael supports Chinese companies in their “going abroad” activities, including business expansion and IPOs in Europe.
Besides his expertise regarding the general foreign investment corporate matters, he specializes in IT regulatory, data protection issues and other new technology driven sectors. He is familiar with the rapidly developing TMC sector in China. He quite often publishes articles and frequently comments on IT and data protection related legal topics.
In 1997, Michael was admitted to the Chinese bar. After practicing in domestic law firms, he worked in the Beijing office of a major international law firm from 2000 to 2002. In 2002, he joined Taylor Wessing in the Shanghai office. As of 2007, he has been appointed as a senior counsel of Taylor Wessing. Michael speaks Mandarin, Fujian dialect as well as English fluently. Michael also serves as an arbitrator of the Shanghai International Arbitration Center.
