Window of Opportunity for Chinese Investors

Chinese investors have a window of opportunity to take advantage of lower asset valuations and subdued M&A appetite in the global mining and metals sector to secure assets and meet the 13th Five Year Plan objectives, according to EY Global Mining & Metals Leader Mike Elliott. Elliott says that while China has been the leading buyer of mining and metals assets globally for the first nine months of 2013 with 8% of all deals by value, investors will face increasing competition from global private capital investors.”Larger global mining companies are focused on greater capital management and have more assets for sale that at any other time than in the past decade. At the same time, small and medium sized miners are being starved of capital and need to sell assets or find new partners who bring capital. There is a window of opportunity for Chinese investors with an eye to the longer term to take advantage of the large number of assets available – this is unlikely to be repeated for some time.”

KPMG Opens New Office in Foshan, China

Sino-Swiss Trade and Direct Investments and M&A in Switzerland

Global Firms Facing Human Resources Challenges in Asia

It’s tough for firms to get and keep the right people, who are often quick to seize new opportunities. While companies in Europe are struggling with sluggish demand and a gloomy employment market, Asia seems a land of promise: booming economies, robust demand, and a resilient job market. But for those who are actually doing business here, there are also some challenges: the business opportunities are there but local competition is fierce, and while the supply of college graduates is huge, the right candidates are hard to find, and when they are found, the prosperous market means that they may easily move to rival firms. Cindy Chen, regional head in Northeast Asia of Adecco Group, a Switzerland-based global human resources company, said in an interview with China Daily that retaining talent is the biggest headache for multinational companies operating in Asia and China.

WunschARB ‘Chinese Court Decision Summaries on Arbitration’ Officially Launched

On 16 September 2013, Wolters Kluwer Law & Business officially launched the ‘Chinese Court Decision Summaries on Arbitration’, a collection of English summaries of Chinese court decisions related to arbitration on Kluwer Arbitration (the ‘Collection’). The Collection currently consists of 126 case summaries of cases concerning enforcement of arbitral awards. These concise summaries will help users conduct research on specific recurring issues when conducting arbitration with Chinese parties, whether in or outside China. The concise summaries aim to lay out and explain the most relevant issues, arguments and outcome of a case, and they will aid user in deciding whether it is worth dedicating the time needed to read the full decision – and in many instances, whether it is worth translating the full decision into English. This Collection is part of the WunschARB’s efforts to contribute bridging the gap between the Chinese and the international business community, in particular in the field of dispute resolution. Other projects involve the organization of workshops such as ‘Advocacy Skills in International Arbitration’ and meetings of the ‘China Young Arbitration Group’.
