Most multinational corporations (MNCs) in China will use the technology and trademarks of offshore companies in order to conduct business in China. This often involves cross-border royalty payments, which have been a hot topic of concern for the customs and tax authorities. The issue of whether the royalty payments will be taxed by the customs and tax authorities and thus trigger double taxation is always a concern for MNCs in China. In addition, whether failure to declare royalties related to imported goods to customs in a timely manner triggers a customs investigation and, ultimately, whether administrative penalties will be imposed.
In this seminar, SwissCham is delighted to invite Philip Lazare, Partner at Shaohe Law Firm and Qin Zhu, Senior Associate at Shaohe Law Firm, to give some tips on the key points of customs and tax compliance that MNCs should be aware of in relation to cross-border royalty payments. The speakers will also give advice on how to avoid "double taxation" of cross-border royalty payments in China. Moreover, since there is a big difference in the way of thinking and approach between customs investigation and tax investigation, they will share their experience in assisting clients in responding to customs investigations of cross-border royalty payments.

Since the government has eliminated the COVID restrictions in December, China's economy is looking to recover rather quickly in 2023. However, not all industries and sectors will see improvement right away. Construction and real estate have structural problems, while consumer spending remains a black box, since it is not clear how much of the savings are going to be spent in the recovery phase. At the same time, exports will likely not be a growth driver the way it has been in 2022 due to lower demand from overseas.
What can companies in China and firms around the world doing business with China expect from the year 2023? To break this down and provide a thorough analysis, we are delighted to have David Wang with us. David is the Head of Asia Economics (ex Japan) and the Chief China Economist at Credit Suisse. He joined the Swiss bank in 2018 and previously worked at the International Monetary Fund, Black Rock and Morgan Stanley.

[Members Only Workshop] What lies ahead? An Economic Outlook in 2023
We are glad to invite you to our first workshop of the year, "What lies ahead? An Economic Outlook in 2023". Mr. Martin Matter, Head of the Swiss Embassy's Economic, Finance, and Trade Section, will present the Embassy's updated China Economic Report 2022, published in December. Following the presentation, there will be a roundtable discussion with the Swiss Embassy and SwissCham Members about the economic outlook for 2023 and the challenges that Swiss companies face in China. Both parties will be able to ask questions, exchange views and share their opinions. We will not record the roundtable discussion and will adhere to the Chatham house rule. We'll then continue the conversation over a cocktail reception, where you may try some finger foods and wines.
